THE CHANGING SOURCES OF ISLAMIC LAW ACROSS HISTORICAL PERIODS AND THEIR ROLE IN ITS EVOLUTION AND CONTINUOUS MOVEMENT

Abstract

ملخص البحث 

تتناول هذه الورقة البحثیة المراحل التطوریة للشریعة الٳسلامیة، وکیف حددت هذه الشریعة الفترات التاریخیة، وبأي شکل هي توجد ٲماماً الیوم۔ لقد استمرت عجلة الشریعة الإسلامية في الدوران عبر مساراتها وفتراتها المختلفة، دون أي توقف۔ خلال العصر النبوي، اعتمد القانون الٳسلامي علی الوحي۔ وفي العصر ما بعد النبوي، بقیت مصادر القانون علی حالها، ولکن برزت الحاجة إلى الفقهاء تدريجيا. مصادر الشرعیة الإسلامية ثابتة فی أصلها ولکن عبر الفترات التاریخیة کانت هناك تغیرات فی استخدامها وتطبيقاتها. توضح هذه الدراسة ما إذا کانت هذه التغیرات علامةً علی التطوّر أم أنها تحدث نتیجةً لتأثيرات الظروف والأحداث. إن المشکلة الأساسية في البحث الحالي هي تو ضیح التغیرات في الفترات التاریخیة المختلفة للقانون الإسلامي وعلاتها بالتطور القانوني. دراسة التغیّرات التي طرأت علی مصادرالشریعة الإسلامية والقانون الإسلامي خلال مختلف الفترات التاریخیة۔ وفهم تأتير المذاهب الفقهية وتوجهات الفقهاء وهو یوضح الدور المهم الذي لعبته هذه التغییرات في تطوّر الشریعة الإسلامية، ویبیّن یوضح أن الشریعة الإسلامية هي شریعة دینامیکیة، وکیف تعمل کنظام متطور. في هذا البحث، سیتم اعتماد المنهجية التحلیلیة لفهم التغیّرات التي طرأت خلال الفترات التاریخیة، وأسبابها، والاَثار التي أحدثت۔ سیستخدم المنهج المقارن لدراسة مختلف المذاهب الفکریة، إلى جانب دراسة المصادر الأولية والثانویة للشریعة الإسلامية، مثل مبادٸ الفقه والکتب الفقهية والأبحاث المعاصرة. تظهر هذه الدراسة أن مصادر الشریعة الإسلامية ثابتة في جوهرها بشکل الأساسي، ولکن علی مرّ العصور التاریخیة طرأت تغییرات تطوریة علی تطبیق هذه المصادر. ویترتب علی ذلك أن القانون الإسلامي هو نظام متطور، یظل متمسکاً بمبادئه الأساسية عبر الزمن، بینما یحدث تغییرات في تطبیقه وفقاً للظروف والأحداث. یتناول هذا البحث أساليب وسمات الفقه في العصور المختلفة، ویوضح سمات النظام القضائي۔ ويعدّ هذا البحث، علی وجه الخصوص دلیلاً قاطعًا لمن یعتبرون القانون الإسلامي جامدًا، علی أنه القانون الإسلامي دینامي  ومتطور وأن الشریعة الإسلامية دینامیة ولیست جامدة. یمر القانون الإسلامي بمراحل متعددة، مما یجعله نظاماً دینامیاً۔ وتظهر هذه الدینامیة استقرار القانون الٳسلامي وقدرته علی مواجهة تحدیات کل زمان، کما تثبت طبیعته التطوریة قدرته علی تقدیم حلول لجمیع أنواع القضایا المعقدة في أي عصر، والحفاظ علی استدامة النظام القانوني.

ABSTRACT

This research paper discusses the evolutionary stages of Islamic law, how Islamic law has defined historical periods and in what form it exists before us today. The historical wheel of Islamic law has kept moving, rolling through the paths or different periods, without any stagnation. During the Prophetic era, Islamic law depended on revelation. In the post-Prophetic era, the sources of law remained the same, but gradually the need for jurists became apparent. The sources of Islamic law remain fundamentally constant, while their use and application have evolved over time. This study clarifies whether these changes are indicative of development or a result of the influence of circumstances. The central problem addressed in this research is to explain the changes in Islamic law during different historical periods and their relationship to legal development. This study examines the changes that have occurred in the sources of Islamic law and jurisprudence throughout different historical periods. It highlights the significant role. These changes played in the development of Islamic law and demonstrates how it functions as an evolving framework. This research will adopt analytical and comparative methodology to examine different schools of thought, as well as to study primary and secondary sources of Islamic law, such as the principles of jurisprudence, books of jurisprudence, and modern research. This study shows that the sources of Islamic law are stable in their origin, but there have been evolutionary changes in the application of the sources of Islamic law over historical periods. This leads to the conclusion that Islamic law is an evolving system that remains true to its foundations while adapting its application to changing circumstances. This research describes the styles and character traits of jurisprudential eras and clarifies the character traits of the judicial system. In particular, this research is a clear demonstration to those who consider Islamic law static, how Islamic law is dynamic and not static. Islamic law goes through various stages, so it is dynamic. Dynamism shows that Islamic law is stable and faces the challenges of all times. The evolutionary nature of Islamic law proves that it provides solutions to all kinds of difficult cases of any era and keeps the legal system sustainable.
