يُعالج هذا البحث ظاهرة نشوز المرأة من منظور فقهي، حيث يهدف إلى تحديد أسباب هذه الظاهرة وتقديم الحلول الشرعية المناسبة لها. ومن بين أبرز أسباب النشوز المشكلات النفسية والاجتماعية، سوء معاملة الزوج، وضعف التفاهم بين الزوجين. ويعتمد البحث على المنهج الفقهي التحليلي من خلال دراسة النصوص الشرعية وآراء الفقهاء. كما يناقش البحث الحلول الشرعية لهذه الظاهرة، مثل التوجيه والإصلاح، اللجوء إلى القضاء الشرعي، وتطبيق العقوبات المشروعة وفق الضوابط الفقهية. وقد توصلت الدراسة إلى أن معالجة نشوز المرأة تتطلب حلولًا شرعية قائمة على العدل والتوازن، مع مراعاة الجوانب الاجتماعية والنفسية لضمان استقرار الأسرة.

ABSTRACT

This study examines the phenomenon of a wife's defiance (Nushuz) from an Islamic jurisprudential perspective, aiming to identify its causes and propose appropriate Sharia-based solutions. Among the primary causes of Nushuz are psychological and social issues, mistreatment by the husband, and lack of mutual understanding between spouses. The study adopts an analytical jurisprudential methodology, relying on Islamic texts and scholars' opinions. It also discusses Sharia-compliant solutions to this issue, such as guidance and reconciliation, resorting to Islamic courts, and applying lawful disciplinary measures within Islamic legal boundaries. The study concludes that addressing Nushuz requires equitable and balanced legal solutions, while considering social and psychological aspects to ensure family stability
